The privacy of an individual's personal information is treated as extremely important by Creditworks Australia Pty Ltd (CWA). We are committed to protecting and maintaining the privacy, accuracy and security of your personal information. We are bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth) as well as other applicable laws and codes.

In this Privacy Policy, "Services" means our services from time to time, "Site" means Our website at www.creditworks.com.au, "We", "CWA" and "Creditworks" means Creditworks Australia Pty Ltd and "Us" and "Our" have corresponding meanings and "You" means all individuals including Our clients and other persons whose personal information we deal.

"Personal information" means information or an opinion about an identified individual, or an individual whose identity is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

What and How Do We Collect Your Personal Information?

We may collect personal information about You for the purpose of providing Our Services. In particular, we may collect personal information about You through your involvement in business/es who wish to obtain commercial credit from Our clients, in circumstances where Our clients have requested Our Services in relation to that business ("Service Collected Information"). This Service Collected Information may include Your:

  • Name and Gender;
  • Address;
  • Telephone Number/Email;
  • Date of Birth; and
  • Financial information such as assets

In addition, we may also collect your credit information such as consumer/commercial defaults from Our clients when they use Our Services after they have collected it from a credit reporting body.

We may also utilise "cookies" which enable us to monitor traffic patterns and to serve You more efficiently if You revisit the Site. A cookie does not identify You personally but it does identify Your computer. You can set Your browser to notify You when You receive a cookie and this will provide You with an opportunity to either accept or reject it in each instance.

Why Do We Collect Your Personal Information?

We may collect personal information about You when You visit this Site, use Our Services or are an information subject a Service we provide to Our clients. In addition to using this personal information to provide Our Services, this information may be used:

  • to send news, information and material about Our Services and general promotional material which We believe may be useful to You;

  • to Our client, at Our client’s request, in the provision of Our Services specifically to that client.

It is unlikely that we will disclose Your personal information to overseas recipients. We may, in some circumstances, disclose personal information to Our clients, or their related companies, that are located outside of Australia.

Security of Your personal information

CWA recognises the importance of ensuring that all personal information is securely held at all times. CWA collects and holds personal information only where it is reasonably necessary for the provision of Our Services or You have otherwise consented.

CWA takes reasonable steps to ensure all records held are securely stored and accessed only by authorised personnel for valid purposes. We also take every step to ensure that the personal information we may hold is up-to-date, accurate and complete.

Access to, and correction of, Your personal information

You are entitled to access personal information relating to You that We hold. You are entitled to seek correction of such information or delete such information unless We are required by law to retain it.

A fee will not apply for making an access request for Your personal information. A fee may be charged for providing the information to You. The fee covers the cost to us in collating, copying and providing certain information for You.

In some circumstances, We may refuse to provide You with access to Your personal information including, but not limited to, where:

  • giving access would have an unreasonable impact on the privacy of others;
  • the information relates to existing or anticipated legal proceedings and the information would not be discoverable in those proceedings;
  • giving access would be unlawful;
  • denying access is otherwise required or authorised by law; or
  • the request for access is frivolous or vexatious.

If We refuse to provide You with access to Your personal information, We will provide You with an explanation in writing no later than 30 days after the access request.

Similarly, in some circumstances, We may refuse to correct Your personal information. If We refuse to correct personal information We hold about You, We will provide You with an explanation in writing by no later than 30 days after a request for correction.
